OVERVIEW

The Skate Retreat offer retreats to connect likeminded women, through skateboarding and other activities.

We work with suppliers, instructors and accommodation providers, to run trips that connect likeminded women.

Your contract incorporates these booking conditions, and by making a booking with us, you confirm your acceptance of these conditions.

When booking through The Skate Retreat you agree to the Terms and Conditions set by both the supplier/provider and The Skate Retreat.

Please read carefully and let us know if you or your group have any questions relating to these terms and conditions.

BOOKING TERMS AND CONDITIONS FOR DAY WORKSHOPS

Your contract is with The Skate Retreat (hereinafter called ‘we or us’). These booking conditions together with the details in our information pack form the basis of your contract with us.

When booking a workshop, a contract is made when we confirm the booking in writing. The person making the booking and signing the booking form (hereinafter called ‘you’ or ‘the client’?) accepts responsibility for payment for everyone listed on the booking. You are also responsible for ensuring that all other persons listed on the booking form read these booking conditions and are fully aware of the booking conditions and course details and requirements. All participants must complete the attached declaration before they will be allowed to take part in any skate lessons. The Skate Retreat do not accept any liability for any loss caused by failure to complete the declaration.

Payment

A deposit of 50% per person is payable at the time of booking. The remaining balance is due four weeks before the course start date. If you book less than four weeks before course start date, the full balance must be paid at the time of booking. Final reminders will be sent and if the balance is not paid prior to the workshop we reserve the right to re-allocate or cancel the booking.

We will always attempt to contact you prior to taking this action.

Changing your booking

We will make every effort to arrange any change of date you request after the booking has been confirmed, providing it is no more than 7 days before the course start date. Any changes are subject to availability of workshop places and we charge an administration fee relative to the duration of the course. The administration fee is £10 per person for changing the date of a 2 day Full Course. The administration fee is £5 for changing the date of the 1 day Half courses.

Cancellations

If any named person or you on the booking form need to cancel the booking once it has been confirmed, we must be notified via e-mail only. The date on which written notification is received will determine the level of cancellation charges applicable. Charges will be levied at the following percentages of total course cost:

Please note that your travel insurance may provide a full refund if the reason for your cancellation falls within the terms of your policy and we therefore recommend that clients take out a suitable insurance policy prior to booking a course with us.

Course participation, Liability and Other Important Information

The activity of skateboarding carries with it a degree of risk both to people and property, even if enjoyed under proper supervision by qualified instructors. It is also a strenuous activity that requires those taking part to have a reasonable standard of fitness. You must therefore make us aware of any medical conditions, illnesses or allergies you have and any prescribed medication you are taking on the booking form at the time of booking and to your skate instructor prior to the workshop start.

For course participants under 18 years old it is the responsibility of the parent or guardian to inform us of any medical conditions. You should not participate in any skateboarding course with us if you are suffering from a heart condition or any other injury / illness which may affect you physical ability or if you are pregnant. You must be able to jog at least 50 metres and must in no circumstances be under the influence of any alcohol or illegal drugs. Also, you must not be under the influence of medication which may adversely affect your physical abilities.

You must agree to abide to all instructions and decisions that The Skate Retreat and our instructors make in order to secure the safety and comfort of all participants. You will have the use of The Skate Retreat equipment during your lessons. Whereas we take all reasonable measures to ensure the safety and good condition of that equipment, you are responsible for immediately reporting any damage caused to the equipment or which becomes apparent whilst the equipment is in your possession.

The Skate Retreat does not seek to limit or exclude any liability for personal injury or loss of life to participants which may occur as a result of its own negligence or that of our employees. However, The Skate Retreat assumes no liability in respect of any personal injury loss, damage, consequential loss or third party claims which occur through no fault of our own or caused by the negligence of you or one of the participants in your group.

Age restrictions

For safety reasons we are unable to take children under eight years of age on our group lessons without the supervision of parents. We are happy to accept under eights on our one to one coaching courses or in a private family sessions with siblings.

Skate Conditions

In the event that The Skate Retreat or our employees consider the ramp, allotment garden or weather conditions to be unsuitable for skate instruction, we will provide a credit voucher for any lessons cancelled by us. We will make a decision with participants 48 hours before the start of the workshop if it forecast rain for the entire day, but reserve the right to cancel sessions up to the night before if the weather is particularly bad, this is to ensure everyone’s safety and value for money. 

Credit vouchers for any lessons can be used within one year from the date of the cancelled lesson. Any lessons owed are subject to availability and must be booked at least 7 days in advance. We require a new booking form to be completed for credited lessons. All credit vouchers are non-transferable.

Accommodation

The Skate Retreat recommendation to places to stay is intended only as a guide to assist booking accommodation. We assume no responsibility for booking any accommodation and cannot be held responsible for any aspect of or problems arising from workshop members’ accommodation arrangements. We accept no responsibility for accommodation bookings if we need to cancel our workshops for any reason.

Website accuracy

Whilst every effort is made to ensure the accuracy of The Skate Retreat website and promotional material, it is intended only as a guide to the services it provides. We are relieved of any liability due to any errors or omissions it may contain, or any minor discrepancies between the website’s content and that service.

Images

Any likeness or image of you secured or taken on any of our courses or holidays may be used by us without charge in all media for genuine promotional or marketing purposes. This includes promotional materials of any kind, such as brochures, leaflets, videos and the internet. If you would prefer not to be used in any promotional materials please inform us via the form in the information pack and in writing prior to your course.

Prices

The prices listed on our website are correct at the time of publication. Although every effort is made to ensure prices are accurate at the time of publication, price fluctuations can occur due to circumstances outside of our control. Any changes will be made clear at the time of booking.

Data Protection

We occasionally send out e-mails to keep our customers informed of The Skate Retreat news. If you would prefer not to receive our mailings please let us know. Under no circumstances will we pass on your information to a third party.

Law and Jurisdiction

These conditions form a contract between us which will be construed in accordance with English Law and it is agreed between us that each will submit to the jurisdiction of the English Courts.

BOOKING TERMS AND CONDITIONS FOR MIDWEEK RETREATS

1 YOUR BOOKING

1.1 When booking a weekend retreat or holiday through us you agree to both our Terms and Conditions, and those set by the accommodation provider and/or skatepark.

1.2 When booking, you also enter into a booking contract between yourself and the accommodation provider and/or skatepark. It is your responsibility to check the booking conditions of the supplier before entering into an agreement.

1.3 When you make your booking, you agree that you have authority to accept and do accept on behalf of the party named in your booking, the terms of our Terms and Conditions and the Booking Conditions of the supplier.

1.4 The person making the booking must be at least 18 years of age and authorised to do so by all persons named in the booking.

1.5 You are responsible for making all payments due to us under your booking.

1.6 A booking contract will exist as soon as we issue you a booking confirmation invoice via email.

1.7 Once you have received your booking confirmation invoice please check this carefully. If any of the information contained within the Booking Invoice is incorrect or incomplete, please notify us immediately as it may not be possible to make later changes to it. We do not accept any liability if we are not notified of any inaccuracies within 14 days of issue of the Booking Confirmation Invoice to you.

1.8 We reserve the right to refuse to accept bookings at our absolute discretion without stating the reason for doing so.

1.9 You agree not to hold The Skate Retreat responsible or for any inconveniences, financial losses, injury from the retreats. We strongly recommend you take out comprehensive travel insurance at the time of booking.

2 SPECIAL REQUESTS

Special requests must be made at the time of booking. We cannot guarantee that the request will be met and any failure to do so will not be a breach of contract on our part. Confirmation that a request has been made will be sent to you in an email upon the acknowledgment of request. We are unable to accept bookings which are conditional upon a special request being met and these will be treated by us as a standard booking.

3 PAYMENTS

3.1 In order to book your chosen trip, you must pay the required deposit within 72 hours of booking. This will vary depending on the retreat. We will inform you of your payment terms at the time of booking.

3.2 Your booking is not secured until we receive payment of your deposit and you have received confirmation from us. Our trips have limited availability, so early booking is advised to avoid disappointment. We advise you not to book any travel arrangements until your trip has been confirmed by us.

3.3 You must pay the full balance by the due date set at the time of booking. If full payment is not received by the balance due date and/or prior arrangements, we will cancel your booking and you will receive a refund, less your deposit, and £25 administrative fee.

3 HOLIDAY PRICE

3.1 We reserve the right to alter the prices of any of the holidays shown on our website. You will be advised of the current price of the trip you wish to book before your contract is confirmed and this price will remain the same.

3.2 Prices are subject to currency conversion rates, the final balance payable will be based on the currency conversion rate at the time your final payment.

4 TRIP CHANGES OR CANCELLATIONS BY YOU

4.1 Changes and cancellations by you may be subject to cancellation/amendment fees and/or non-refundable deposits.

4.2 The Skate Retreat reserves the right to charge an administration fee of £25 for any amendments (ie group bookings) or cancellations made within 60 days of retreat commencement. Any cancellations made within 30 days of retreat commencement will be subject to an administration fee of £50. These charges are to cover losses incurred from prior commitments to Suppliers/Providers.

4.3 If any named person or you on the booking form need to cancel the booking once it has been confirmed, we must be notified via e-mail only. The date on which written notification is received will determine the level of cancellation charges applicable. Charges will be levied at the following percentages of total course cost:

5 TRIP CANCELLATION BY THE SKATE RETREAT

5.1 Some trips will be subject to group size minimum in order to run, and therefore occasionally have to be cancelled if this is the case, we will inform you at the earliest convenience and will refund your booking.

5.2 You agree not to hold us responsible or for any inconveniences or financial losses from any trip cancelled by The Skate Retreat. We ask that you do not book any travel arrangements until we have confirmed that your trip has reached the group size minimum to run.

7 COMPLAINTS

7.1 If you are unsatisfied, please contact us via email relax@theskateretreat.com as soon as possible, within 28 days of your return whereby we will investigate your complaint.

10 HEALTH REQUIREMENTS

10.1 You must provide us with full details of any existing medical condition or disability that may affect your trip (including, in particular, any accommodation requirements) at the time of your booking.

10.2 If in our reasonable opinion your chosen holiday arrangements are not suitable for your medical problem or disability or you are not travelling with someone who can provide all assistance you may reasonably require, we have the right to refuse to accept the booking.

10.3 If you do not give us full details of your medical problem or disability, we can also cancel the booking when we find out full details if in our reasonable opinion, the holiday arrangements are not suitable or you are not travelling with someone who can provide all assistance reasonably required.


11 INSURANCE

11.1 Taking part in activities, adventure sports, action sports carries a high risk of damage, personal injury or death. We do not accept or assume any responsibility or liability for accidents, injuries or even death occurred while taking part in any trip.

11.3 You highly recommend that you take out suitable insurance for all your needs before you travel. We cannot be held responsible for any costs you may incur as a result of failing to do so.

11.4 If you take part in activities whilst on holiday that have been organised and arranged independently of us, participation is at your own risk and it is your responsibility to ensure that you have obtained the relevant insurance.

12 YOUR RESPONSIBILITIES AND BEHAVIOUR WHILST ON HOLIDAY

12.1 As part of your booking with us, you are accepting liability for any loss or damage caused by you during the course of your holiday. Payment for any loss or damage must be made to us at the time that it occurs or as soon as is reasonably practicable thereafter.

12.2 If the cost of the loss or damage is not known at the time, we will reasonably estimate it and if this reasonable estimate exceeds the amount paid, you must pay the difference once known, and if it is less, the difference will be refunded to you. You will also be responsible for, and agree to indemnify us, in respect of any claim subsequently made against us and all costs incurred by us (including our own and any other party’s full legal costs) arising from your actions.

12.3 You are also responsible for the behaviour of yourself and other members of your party. We can refuse to accept you as a customer or refuse to continue dealing with you and/or any other member of your party by terminating your holiday arrangements if yours or their behaviour is or is likely to be, in our reasonable opinion or in the reasonable opinion of our suppliers/providers, disruptive, upsetting or dangerous to yourself or anyone else, or if you or any member of your party have caused or are likely to cause damage to property. In these circumstances, we will not pay any refund, compensation or other sum whatsoever or any costs or expenses incurred by you if we have to terminate your travel arrangements due to such unacceptable behaviour. In this situation we will have no further responsibility for you or any other member of your party (including any return travel arrangements).

12.4 We cannot be held responsible for the actions or behaviour of other guests on the trip.

14 OUR WEBSITE AND ADVERTISING

14.1 The information contained in our website and advertising material is our responsibility and to the best of our knowledge and belief it is correct at the time of publication. Occasionally errors may occur and information may change and you must therefore check all the details of your travel arrangements at the time of booking.

15 TRAVELLING TO YOUR TRIP

15.1 We are not responsible for how you arrive at the starting point or trip location. We will provide information regarding how to get there, however it is your responsibility to research and make your own travel arrangements.

15.2 With your permission we will connect you with other guests joining your trip, to see if you can arrange your travel together. You take full responsibility for your own travel plans.

15.3 If you choose to share cars with other guests whilst on a trip, The Skate Retreat is in no way responsible for any risk, injury or death occurred through car sharing.

16 DATA PROTECTION

16.1 Information about you or members of your party, including your names, contact and details and any special needs, disabilities, dietary requirements collected by us when you request information or making a booking with us. We may disclose this information to our service for the purpose of providing you with your holiday arrangements. Only information necessary for this purpose will be disclosed to them. On occasions, it may be mandatory for us to disclose information for security and terrorism purposes and any other purpose imposed upon us by governments or other regulatory authorities. We may use your information for the purposes set out in our Data Protection Registration with the Office of the Information Commissioner. We may disclose this information to companies which act as data processors on our behalf. Some information, for example relating to your religion or health, may be “sensitive personal data” within the meaning of the Data Protection Act 1998. We need this information to cater for your needs, but it is collected on condition that we have your positive consent. If you do not agree with our use of your information, we cannot accept your booking. By making a booking with us, you agree to allow your insurers, their agents and medical staff to disclose relevant information to us in circumstances where we may need to act in the interests of everyone in the group with whom you are travelling.

LAW AND JURISDICTION

These Booking Terms and Conditions are governed by English Law with any action arising out of it being subject to the exclusive jurisdiction of the courts of England and Wales.
